Endless Blue Maui Vacation Rental Agreement & House Rules
Property: Endless Blue at The Mahana
Location: Kāʻanapali, Maui, Hawaiʻi
Guest(s): The individual booking the reservation (“Guest”) and any second occupant.
This Rental Agreement outlines the terms and conditions under which the Guest may occupy the Property. By booking and/or occupying the Property, the Guest agrees to all Rental Conditions and the House Rules.
1. Reservation, Payment & Cancellation
1.1 Payment: All rental fees, taxes, and required payments are due in accordance with the booking platform’s policies (e.g., VRBO, direct booking website, etc).
1.2 Taxes: Guest is responsible for all required Hawaiʻi and Maui taxes.
1.3 Cancellation: Guests must cancel at least 60 days before check-in to receive a 100% refund for all nights, minus a 10% processing fee. Guests must cancel at least 30 days before check-in to receive a 50% refund for all nights, minus a 10% processing fee. If a guest cancels less than 30 days before check-in, you’ll be charged 100% for all nights and a $250 cancellation fee. Date Changes: Date changes requested within the cancellation window are treated as cancel.
1.4 Officially Declared Maui Emergencies: In the event of an officially declared Maui emergency (government-mandated closures, evacuation orders, or other situations announced by Maui County or the State of Hawaiʻi)—Guests will be offered either a full refund or a no-fee rebooking credit toward a future stay, subject to availability.
1.5 Travel Interruptions: Refunds or credits will not be issued for personal emergencies, airline delays or cancellations, weather conditions that do not result in a government declaration, or other travel disruptions outside the Host’s control. Travel insurance is STRONGLY recommended.
1.6 Chargebacks: Any chargebacks or reversed payments will be treated as a cancellation, and Guest is responsible for all associated fees.
2. Check-In / Check-Out
2.1 Check-In Time: 4:00 PM HST
2.2 Check-Out Time: 11:00 AM HST
2.3 Early Check-In / Late Check-Out: Early check-in and late check-out are available only with prior written approval and may incur additional fees. Early check-in or late check-out can only be confirmed on the day of arrival or departure, subject to availability. Late check-outs cannot extend past 12:00 PM HST. For guests seeking an evening departure to accommodate red-eye flights, a full additional night must be booked.
2.4 Gate Access: Guest will receive a gate code to access the boardwalk during self check-in. This code is for Guest use only and may not be shared.
3. Occupancy Limits
3.1 Maximum occupancy is two (2) people.
3.2 Additional overnight guests are not permitted.
3.3 Parties, events, or gatherings of any kind are strictly prohibited.
4. Use of Property
4.1 The Property is to be used exclusively for residential vacation purposes.
4.2 Guest agrees not to use the Property for any unlawful purpose.
4.3 Moving heavy furniture or décor is not permitted.
4.4 Guest agrees to keep the Property clean and in good order and leave it in similar condition to arrival.
5. Condition of Property / Damage Policy
5.1 Guest agrees to notify Host immediately of any damage, malfunction, or maintenance issue.
5.2 Guest is financially responsible for:
- Damage caused by negligence, misuse, or violation of rules
- Missing items (including beach gear, towels, home decor, etc)
- Excessive cleaning beyond normal use
5.3 Host may charge Guest’s payment method on file for damages, replacement costs, excess cleaning, or violation fees.
6. Safety & Liability
6.1 Guest acknowledges the oceanfront location and agrees to use caution on the lanai. No leaning, sitting, or climbing on the railings.
6.2 Guest is responsible for the safety of all occupants and belongings.
6.3 Host is not liable for injuries, accidents, death, theft, weather conditions, insects, or acts of nature occurring during Guest’s stay.
6.4 Personal property is Guest’s responsibility. A safe is provided in the walk-in closet.
7. Prohibited Activities
7.1 Smoking or vaping of any kind is prohibited inside the unit, on the lanai, and in all resort common areas except for the designated smoking zone marked by resort signage. No drug use of any kind. No marijuana smoking.
7.2 Pets are not allowed anywhere on the Property or resort grounds.
7.3 Glass containers are prohibited in pool or BBQ areas.
7.4 Illegal substances and commercial photography or filming are not permitted.
8. Resort Amenities & Common Areas
8.1 Guest has full access to the resort pool, hot tub, BBQ area, shuffleboard, beach access, filtered water/ice stations, and parking areas.
8.2 Guest may not access any locked or owner-only or staff-only areas.
8.3 All resort rules and posted signage must be followed at all times.
8.4 Beach gear provided by the Host must be rinsed free of sand and returned in good condition.
9. Housekeeping & Cleanliness
9.1 This is a self-catering unit. Daily housekeeping is not provided unless it is arranged in advance with the property manager. An additional fee will apply.
9.2 Guest agrees to:
- Keep doors and screen doors closed to reduce insects and tropical pests
- Store food properly
- Rinse sand outside before entering
- Place trash in the trash chute (located in the utility room left of the stairs)
9.3 Excessive mess requiring additional cleaning may result in a fee.
10. Environmental Considerations
10.1 Maui is a tropical climate. Even with professional pest control, occasional insects may appear. This is normal for Hawaiʻi and not grounds for refunds.
10.2 Guest agrees to follow instructions to minimize insects (keep doors closed, store food, clear counters, daily trash removal).
11. Weather, Interruptions & Acts of Nature
11.1 No refunds or compensation will be issued for:
- Hurricanes, storms, wind, rain, or surf conditions
- Power outages
- Cable/internet interruptions
- WiFi interruption
- Beach closures or construction noise
11.2 Travel insurance is strongly recommended.
12. Termination of Stay
12.1 Host may immediately terminate Guest’s stay without refund if Guest:
- Violates occupancy limits
- Violates smoking/pet policies
- Causes damage
- Disturbs neighbors or violates quiet hours
12.2 Guest must vacate the Property upon request.
13. Governing Law
This Rental Agreement is governed by the laws of the State of Hawaiʻi and Maui County. Any disputes shall be handled within this jurisdiction.
HOUSE RULES:
This is our family’s Maui home, a place we love deeply and personally care for. We’re honored to share it with guests who appreciate comfort, calm, and the spirit of aloha. To ensure an enjoyable experience for you, our neighbors, and future guests, please review and follow the house rules below.
Respect the Home: Please treat the property as you would your own. Remove sandy shoes, keep wet items off furniture, and avoid moving heavy furniture as it may damage the new floors and intentional layout. Only toilet paper should be flushed—wipes, paper towels, or anything labeled “flushable” will clog the plumbing.
Parking: Free parking is included. During your self check-in, you’ll be asked for your vehicle make, model, and license plate. You will receive a printed parking pass that must be displayed on your dashboard at all times. Please park only in the designated resort parking areas.
No Smoking / No Pets: Smoking or vaping of any kind is strictly prohibited inside the unit or on the lanai. No drug use of any kind. No marijuana smoking. There is designated smoking area across from the BBQ. Look for the sign. Pets are not permitted inside the unit or anywhere on the resort grounds—this is a community rule.
Quiet Hours: Mahana has strict quiet hours from 10 PM – 8 AM every night. Please keep noise reasonable at all times out of respect for neighbors. Loud music, parties, or events are not allowed, as this is a peaceful residential community.
Beach Gear & Resort Amenities: We provide two beach chairs, an umbrella, boogie boards, a beach bag and a cooler for your use. Please rinse sand from all gear before bringing it indoors and shake out towels outside. Please use the resort towels available in the pool area when enjoying the Mahana pool or beach.
Guest & Visitor Policy: Maximum occupancy is two adults, as shown on your reservation. Additional overnight guests are not permitted. Visitors are welcome, but they must follow all resort rules and quiet hours.
Damage, Safety & Maintenance: Please report any damage or maintenance issues right away. Accidents happen, and early notice allows us to keep the home beautiful. Use caution on the lanai, and do not sit, climb, or lean against the railings. In the event that damage to the property or its contents is not covered by our insurance or it exceeds the security deposit, the cost to repair or replace will be billed to the guests.
Trash & Maui Environment: Because Maui is a tropical environment—even in well-maintained, professionally treated homes—you may occasionally see island insects. This is normal for Hawaii, and we take every step to keep the condo clean and comfortable. To help keep the home comfortable:
– Keep doors and lanai screens closed
– Store food promptly and sealed
– Wipe counters regularly
– Empty trash daily
The trash chute is located just outside the unit: walk toward the stairs and enter the “Utility Room / Trash Chute” door on the left. The chute labeled “Rubbish” is inside. A larger trash room is also available on the ground level, in the parking lot.
Provided Cookware: Our kitchen is equipped with high-quality, induction-ready non-stick cookware that is specifically designed for the induction stovetop in the condo. Induction cooktops only work properly with the right type of pans, and using non-compatible cookware can cause the burners to malfunction, scratch, or shut off — and may damage the surface. For this reason, please use only the pots and pans provided in the unit when cooking.
Aloha Spirit: We ask that you treat our home, furnishings, and common areas with care. Please leave the home in good order at checkout, just as you found it. Your respect helps preserve this space for everyone who loves Maui as much as we do.
Acceptance of Terms
By booking and occupying the Property, Guest acknowledges they have read, understand, and agree to these Rental Conditions and the House Rules. Violations may result in additional charges or immediate termination of stay.
